GENEVA, July 2 (Reuters) - A U.N. human rights investigator on Thursday called Israel's seizure of a ship carrying relief aid for the Gaza Strip "unlawful" and said its blockade of the territory constituted a "continuing crime against humanity".

Israeli authorities on Tuesday intercepted the vessel, which was also carrying 21 pro-Palestinian activists, and said it would not be permitted to enter Gaza coastal waters because of security risks in the area and its existing naval blockade.

Richard Falk, the United Nations special rapporteur on human rights in the Palestinian territories, said the move was part of Israel's "cruel blockade of the entire Palestinian population of Gaza" in violation of the Fourth Geneva Convention prohibiting any form of collective punishment against "an occupied people".

Falk, an American expert on international law, said Israel's two-year blockade of Hamas-ruled Gaza restricted vital supplies such as food, medicine and fuel to "bare subsistence levels". ...

UNITED NATIONS, June 30 (KUNA) -- Amnesty International on Friday accused Israel of war crimes in Gaza and the Palestinian militias of violation of fundamental principles of international law by kidnapping Corporal Gilad Shalit and killing settler Eliyahu Asheri, urging the international community to act.

'Deliberate attacks by Israeli forces against civilian property and infrastructure in the Gaza Strip violate international humanitarian law and constitute war crimes,' Amnesty International said in a statement distributed here.

Israel 'must now take urgent measures to remedy the long-term damage it has caused and immediately restore the supply -- at its own cost -- of electricity and water to the Palestinian population in the affected areas,' the organization said.

'As the occupying power, Israel is bound under international law to protect and safeguard the basic human rights of the Palestinian population,' it added.

The extensive damage caused by Israeli artillery and air strikes against these facilities in recent days is estimated at several millions of US dollars and will require months of work to repair.

'Unless alternative emergency measures are promptly put in place to restore electricity and water supply, the consequences could be dire for the health of the Palestinian population,' it warned."

GAZA - Lutfi Halawa stood beside the hospital bed of his nine-month old daughter Isra, praying power cuts hitting the Gaza Strip will not shut down her ventilator.

“Without electricity my daughter will die,” he said.

Palestinian health officials say an Israeli air strike, which knocked out Gaza’s main power plant has put the lives of hundreds of patients in imminent danger.

The attack was part an Israeli offensive to free a soldier captured by Palestinian militants last Sunday. Israel, which provides most of Gaza’s electricity, says it has boosted supplies because of the current situation."

But the United Nations and the International Committee for the Red Cross say the strike has cut vital electric power for hospitals as well as families. Air strikes have also knocked out water supplies, they said.

Israel’s closure of Gaza’s borders has also halted commodities including gasoline, meaning the fuel Palestinians are using to power home generators is being depleted.

Al Naser hospital for children, where Isra is being treated, has been relying on a generator during power cuts. But its gasoline reserve will only last four to five days, doctors say.

“Those patients await their execution if the gasoline runs out and electricity remains cut. Those who destroyed the power plant will be responsible,” said doctor Majed Awadallah, head of an intensive care unit treating five infants.

“The difference is that people who usually await execution are criminals and these are innocent children,” he said

Israeli ministers were secretly warned just after the Six-Day War in 1967 that any policy of building settlements across occupied Palestinian territories violated international law.

A "top secret" memo by the Foreign Ministry's then legal counsel said that would "contravene the explicit provisions of the Fourth Geneva Convention". Growth of Jewish settlements over the next three decades followed.

The official advice that a policy which is now a major obstacle to a peaceful settlement of the Israeli-Palestinian conflict had no basis in international law has been highlighted by the Israeli historian, Gershom Gorenberg. His new book, The Accidental Empire: Israel and the Birth of the Settlements will generate fresh debate on the legality of the West Bank settlements in the wake of Ariel Sharon's decision to withdraw 8,500 settlers from Gaza last August.

Most of the international community has held that Jewish settlement in the territories seized in the 1967 war contravened international law, and the Geneva Conventions in particular, but this has long been publicly contested by Israel.

The highly classified internal advice was given by Theodor Meron, who left Israel a decade later and became a leading international jurist who until the end of last year was president of the International Criminal Tribunal for the former Yugoslavia.

After the 1967 Israeli prime minister, Levi Eshkol, made it known he wanted settlements in the Golan Heights, seized from Syria in the war, and in the Jordan Valley, to make Israel's borders more defensible, Mr Meron was asked whether international law allowed such settlement.

The counsel sanctioned short-term settlement "by military bodies rather than civilian ones", but explicitly ruled out civilian settlements which were energetically established by successive Israel governments, leading to an Israeli population of more than 240,00 in the West Bank today.

The Israeli acting Prime Minister, Ehud Olmert, has made it clear that while Israel is prepared to withdraw further settlements from the West Bank, it intends, unilaterally if it cannot reach a negotiated peace deal, to annex territory occupied by others, including the three big settlement blocks of Ma'ale Admumim, Gush Etzion and Ariel. ...

I have a tree in Israel, and I once had a certificate to prove it. In about 1950 a lady from a Zionist organisation planted it for my support of the Zionist Youth Movement in Ireland. But it is all so long ago that it has probably been cut down by now, and I have lost the certificate. At the time, like many young Europeans with left-wing views, as the full horrors of Nazi genocide became known, I supported the new state. But now I have totally changed my mind.

I have reached the conclusion that the Zionists have absolutely no right in what they call Israel, that they have built their state not beside but on top of the Palestinian people, and that there can be no peace as long as contemporary Israel retains its present form. I hasten to make clear that none of this gives me any pleasure, but in the great scheme of things my personal wishes do not weigh heavily in the scale pans of history. I wish I did not think what I do, I hope I am wrong. My conclusions are based on the answers to five questions.

1. Did the Jews of the Old Testament come from what is now Israel? The answer is No.

2. Are the Jews of the world today simply the descendants of the people of the Diaspora two thousand years ago? The answer is, only in part.

3. Does the right of return apply to people who occupied some land two thousand years ago for a historically brief period, to the detriment of those who have been there since? Obviously no. Imagine a world where every people claimed that right.

4. Did the Balfour Declaration give the Zionists the right to establish a state in Israel? The answer is no. At the time the British Government had no right to give.

5. Did the United Nations Resolution of November 1947 give Zionists the right to establish the present state of Israel? The answer is no, and they have continuously and relentlessly violated that resolution for more than half a century, so that any tatters that now remain are void, by their action. ...

A leading QC appointed by ministers to act in secret court hearings for terror suspects is quitting in disgust, describing the law allowing foreigners to be detained indefinitely as 'an odious blot on our legal landscape'.

Ian Macdonald, a Special Advocate before the Special Immigration Appeals Commission (SIAC), is to resign tomorrow from his role defending the suspects. He says the Government's anti-terror legislation, which has kept the suspects in prison without trail for up to three years, is 'contrary to our deepest notions of justice'.
